INFORMATION ON MEDICAL DEVICE TRACKING

Information disclosure note pursuant to article 13 of European Regulation 2016/679.

• The Data Controller
  is De Gotzen Srl with registered office in Via Roma 45 - 21057 Olgiate Olona (VA). Any requests for information and / or clarifications regarding the processing of data may be sent to the following e-mail address: imaging.italysupport@acteongroup.com

• Processing carried out and its purposes
  The Owner wishes to inform you that their company name as well as the address, telephone number and personal data of a contact person will be collected and processed for the purpose of tracing the De Gotzen medical device.
  The data will be collected directly through the software installed on the medical device itself or, alternatively, by registration in a special section on the company website.
  The treatments carried out with the aid of IT tools do not provide for the use of automated decision-making processes.

• Legal basis for processing
  The treatment is carried out based on the existence of legitimate interest by the manufacturer of the device in question, in line with the provisions of current legislation on medical devices and in particular on the traceability of the same.

• Provision of data
  The provision of data is optional, but necessary for the achievement of the purposes mentioned above and the non-availability of the same does not allow the fulfillment of obligations under current legislation.

• Data communication and scope of dissemination
  The data may be disclosed to the following categories of subjects which the Data Controller uses for the performance of certain activities related to the provision of its services: Public Administration for mandatory communications by law. ACTEON group companies that provide technical assistance and manage the traceability obligations of medical devices based on local regulations. The data will not be transferred abroad.

• Storage period
  The data will be kept for the time necessary for the above purposes in compliance with the terms of the law, for the period corresponding to fiscal, accounting, and administrative needs and to document our business and also to respond to your data recovery needs.

• Rights of the Data Subject
  You have recognised and guaranteed full rights to: ask the Data Controller to access your personal data, rectify, cancel or limit their processing or to oppose their treatment, in addition to the right to the portability of data. This right can be exercised by sending an email to imaging.italysupport@acteongroup.com Furthermore, the Data Controller will interrupt processing when the communication of withdrawal of the previously expressed consent is received.

• Complaint to the Supervisory Authority
  Data Subjects have the right to lodge a complaint with the Supervisory Authority in the event that their requests for information addressed to the Data Controller have not been given satisfactory dealt with. The reference Authority is the Italian Data Protection Authority (Garante per la Protezione dei dati personali)
